Substance Abuse Programs and Policies

More than 70 percent of employers across the country are impacted by prescription drug misuse in the workplace, according to a survey released by the National Safety Council earlier this year. Add to that potential alcohol and illegal drug abuse, and the need for an effective substance abuse policy becomes abundantly clear. ES&A attorneys Trisha Gibo and Jessica Sneed presented a webinar on "Substance Abuse Programs," covering the following:

  • Mandatory programs under federal law, including the Drug-Free Workplace Act of 1988 as applicable to federal government contractors and federal grant recipients, Department of Defense regulations, and Department of Transportation regulations
  • Voluntary programs under State of Hawaii law, including testing options and requirements
  • Elements of an effective substance abuse policy
  • Reasonable accommodations required by the Americans with Disabilities Act (ADA) for employees with a history of substance abuse 
  • Medical marijuana and opioids and their effects on drug testing in the workplace
