The United States Department of Labor (USDOL) issued Field Assistance Bulletin No. 2020-4 which states that covered employees’ leave benefit under the Families First Coronavirus Response Act (FFCRA) applies when their child’s summer camp, summer enrichment program or other summer program is closed for COVID-19 related reasons. They are eligible if the child was enrolled before the closure was announced; “affirmative steps” short of actual enrollment (such as intent to enroll, including submission of an application or a deposit, or prior attendance ) may also be sufficient.
