The U.S. Department of Labor (USDOL) has extended the rescission date of the joint employer rule to October 5, 2021. The rule, which originally took effect in March 2020, was to have been rescinded effective September 28. The department believes the rule improperly narrowed the test for vertical employment and conflicted with decades of department interpretation as well as the text of the Fair Labor Standards Act (FLSA) and congressional intent.
