The U.S. CItizenship and Immigration Services (USCIS) has updated its Form I-9 lost document policy, allowing workers a 90-day window to present alternative documents to complete the Form I-9 employment eligibility verification process. This will accommodate possible delays of replacement documents, including delays resulting from government office closures due to the pandemic. The employer will need to complete a new Section 2 on the I-9 form, append it to the previously completed form, and provide an explanatory note. The new policy also applies to receipts for lost, stolen, or damaged documents required during the I-9 reverification process, which will require the employer to complete a new Section 3 to record the substitution.
