On December 9, 2020, the Office of Federal Contract Compliance Programs (OFCCP) published the final rule “Implementing Legal Requirements Regarding the Equal Opportunity Clause’s Religious Exemption” in the Federal Register. The rule clarifies the religious exemption in Executive Order 11246; ensures that religious organizations can participate in federal procurement; and adds several examples to illustrate the types of contractors that may qualify for the religious exemption, which includes a corporation, association, educational institution, society, school, college, university or institution of learning organized for a religious purpose and engaged in activity consistent with that purpose.
