The Office of Federal Contractor Compliance Programs (OFCCP) has introduced a new Pre-Complaint Inquiry Form (CC-390) as part of its complaint intake process. Employees and applicants who believe an employer doing business with the federal government has discriminated against them in employment or in applying for employment may submit either a pre-complaint inquiry or a complaint with OFCCP. The pre-complaint inquiry does not constitute filing a complaint, nor is the inquiry a requirement in order to file a complaint. Filing an inquiry also does not extend the period (from the time of the alleged action) for filing a complaint. OFCCP will review the inquiry to determine if it is the right agency to handle the matter, but it will not notify the employer of the pre-complaint inquiry. For more information, see the FAQ page.
