Increased Penalties for Form I-9 Violations

The U.S. Department of Homeland Security (DHS) recently announced an increase in fines against employers that fail to comply with the rules governing Form I-9 (Employment Eligibility Verification). The revised fine schedule, effective June 28, 2024, includes the following:

• I-9 paperwork violations: $281-$2,789 per Form I-9 
• Knowingly hiring or recruiting, or knowing referral or retention of, unauthorized aliens:
  • First offense: $698-$5,579 per violation
  • Second offense: $5,579-$13,946 per violation
  • Third or more offense: $8,369-$27,894 per violation
