The Pregnant Worker Fairness Act (PWFA), which became effective June 27, 2023, requires covered employers to provide reasonable accommodations for a worker’s known limitations related to pregnancy, childbirth, or related medical conditions, unless the accommodation will create an undue hardship for the employer. The EEOC “Know Your Rights: Workplace Discrimination Is Illegal” poster has been updated to reference the new law, and should be placed in a conspicuous location in both the physical and online workplace. Note that Title VII of the Civil Rights Act of 1964 imposes a monetary penalty for covered employers who fail to post these notices. The penalty, currently $659, is adjusted annually for inflation as required by law.
