The U.S. Department of Labor (USDOL) issued Field Assistance Bulletin No. 2020-4 which states that covered employees’ Families First Coronavirus Response Act (FFCRA) leave benefit applies when their child’s summer camp, summer enrichment program or other summer program is closed for COVID-19 related reasons. They are eligible if the child was enrolled before the closure was announced; “affirmative steps” short of actual enrollment (such as intent to enroll, including submission of an application or a deposit, or prior attendance ) may also be sufficient.
