The Equal Employment Opportunity Commission (EEOC) has issued a fact sheet on bathroom access rights for transgender employees. In addition to other federal laws, the EEOC enforces Title VII of the Civil Rights Act of 1964, which prohibits employment discrimination based on race, color, national origin, and sex (which includes pregnancy, sexual orientation and gender identity). The EEOC holds that denying an employee equal access to a common restroom corresponding to the employee’s gender identity is sex discrimination.
