An EEO-1 Employer Information Report must be submitted by all private sector employers with 100 or more employees as well as federal contractors with 50 or more employees meeting certain criteria. This annual collection of workforce demographic data, including data by job category and sex and race or ethnicity, must be submitted to the Equal Employment Opportunity Commission (EEOC). The deadline to file 2023 EEO-1 reports was June 4, 2024. Employers that to date have not submitted and certified their report must do so as soon as possible, and no later than 11pm EST on Tuesday, July 9, 2024 (i.e., the “Failure to File” deadline). While the EEO-1 reporting requirement has been in place since 1964, the EEOC has not always aggressively or consistently enforced compliance. However, the agency recently filed lawsuits against 15 employers across 10 states for repeatedly failing to file their mandatory EEO-1 Reports, even after the EEOC issued them a notice of noncompliance and a failure to file notification.
