USDOL Proposed Rule Would Extend OT Protections to More Salaried Workers
The U.S. Department of Labor (USDOL) has proposed a rule that would extend overtime protections to more salaried workers. The proposal to “Define and Delimit the Exemptions for Executive, Administrative, Professional, Outside Sales, and Computer Employee”s” would:
- Increase the FLSA regulations’ standard salary level from $684/week ($35,568/year) to $1,059/week ($55,068/year)
- Increase total annual compensation requirement for highly compensated employees from $107,432/year to $143,988/year
- Restore overtime protections for U.S. territories
- Automatically update earnings thresholds every three years to keep pace with changes in worker salaries
The proposed rule was published on Sept. 8, 2023; the public comment period will continue through Nov. 7, 2023.
