USDOL Issues Final Rule Updating Davis-Bacon Act
The U.S. Department of Labor (USDOL) has issued a Final Rule updating the Davis-Bacon Act to better reflect the current needs of construction industry workers on federal projects. The rule is effective October 23, 2023. Among the changes:
- Instead of the current weighted average method, the new rule reverts to the pre-1982 3-step process for determining a prevailing wage, in which the prevailing wage will be based on the wage paid to at least 30% of workers of a particular classification in the local community
- New recordkeeping requirements for employers include maintaining payroll records, employee phone numbers and email addresses for at least three years after the work is completed.
