In August 2022, a Freedom of Information Act (FOIA) request was made to the Office of Federal Contract Compliance Programs (OFCCP) by the Center for Investigative Reporting, a California-based nonprofit news organization, for Type 2 Consolidated EEO-1 Report data submitted by federal contractors and first-tier subcontractors from 2016-2020. The OFCCP notice gave contractors the opportunity to provide written objections to having their EEO-1 Reports disclosed if they believed that the requested information included confidential trade secret, commercial or financial information that should be withheld pursuant to FOIA Exemption 4. Objections were due by Sept. 19, 2022. The OFCCP then compiled a non-objectors list of contractors that submitted the type of data in question but had not submitted an objection to the release of their data. The list was emailed to all contractors and is posted on its Submitter Notice Response Portal.The deadline for contractors to respond if they were incorrectly placed on the list was February 7, 2023, but that deadline has now been extended to February 17, 2023.
